Bold Alliance has filed a motion seeking an extension of time to submit evidence to Nebraska Public Service Commission for its review of TransCanada’s permit application for the proposed Keystone XL pipeline — joined by fellow intervenors Nebraska Sierra Club, the Ponca Tribe of Nebraska, the Yankton Sioux Tribe, and the nearly 100 landowner-intervenors challenging the pipeline permit.
Currently, the deadline is May 30th to submit written pre-filed testimony, exhibits, work papers, witness lists and other evidence to the PSC.
Bold and co-signers of the new motion argue in part that, due to the very recent allowance by the PSC of an additional expert witness for each intervenor class, there is not sufficient time to locate and prepare these additional witnesses by the May 30th deadline.
The motion from Bold Alliance et al. asks the PSC to extend the deadline until June 7th.
Additionally, the motion notes that the PSC Hearing Officer’s most recent ruling gave TransCanada four additional business days to provide responses to discovery requests, while Intervenors were granted only one additional business day, at the end of a major holiday. Read the full motion below.
