Below is a recap of this past week’s news and research related to TransCanada's proposed Keystone XL tarsands pipeline. Nebraska landowners filed a lawsuit about their concerns regarding eminent domain and the process under which TransCanada’s pipeline is being reviewed to the Nebraska Supreme Court. The lawsuit questions the constitutionality of Nebraska’s current pipeline siting law and calls TransCanada’s Keystone XL permit application into question.

PSC Oil Pipeline Rules and Regs, Be Involved

Bold Nebraska submitted comments to the Nebraska Public Service Commission request for public comment as they create the rules and regulations around oil pipeline route certification. We also submitted a legal/policy "green paper" from the Domina Law Group outlining the legal authority the state of Nebraska has when it comes to oil pipelines and eminent domain.  

Our recommendations include guidelines for definitions of public utilities, common carriers, and high consequence areas, as well as criteria for emergency response plans and public transparency.

TransCanada Misleads Public About Pipeline Contents

Now that the "DEQ Open Houses" on the proposed corridor of the TransCanada Keystone XL pipeline are over, we've been hearing a lot of feedback on the information given to citizens by TransCanada representatives at the Nebraska government-backed sessions.

One of the biggest ways TransCanada is misleading the public is in the way they describe (or don't describe) the contents of the pipe itself.  Commonly referred to as tarsands, this "Canadian Crude" (as TransCanada likes to spin it) is diluted bitumen.

The Week in Keystone XL: Eminent Domain and the Truth about Gas Prices

Every week groups on a state and national level compile news stories and reports about TransCanada's Keystone XL pipeline. This week, the Republican leaders' hypocrisy regarding their stance on eminent domain has come to light, the facts about gas prices and energy security around Keystone XL are becoming more prominent, and it appears immediate approval without any further studies on the Keystone XL may not appear in the final transportation bill, thats great news!

TransCanada Lovers Could Derail 1 Million Jobs

Friends of Big Oil have been making a habit in this session of Congress of threatening to scuttle “must pass” legislation in order to hasten construction of the dangerous Keystone XL pipeline.  In June, yet another special interest showdown is looming as Congress takes one more stab at passing a bipartisan transportation bill that enjoys supermajority support in the Senate. At stake are than one million jobs the bill is estimated to create.

For the oil industry’s chief champion in the House, Speaker John Boehner, it’s one more chance to do the bidding of special interests by trying to force lawmakers to accept a highly controversial amendment requiring the pipeline be built. The question is – how far in this game of chicken is he willing to go?  Might he scuttle one million jobs that will be created by the transportation bill so oil companies can reap profits by building the dangerous Keystone XL tar sands pipeline. NWF’s Jeremy Symons said it well a few months ago and it still applies, “Speaker Boehner is willing to put jobs at risk once again by hijacking the transportation bill.”

Primary Election Day is Tuesday, GO VOTE

Tuesday marks Election Day for various primary races. The most notable is of course the GOP US Senate race. Various state senate (Unicam), Regent and energy board (OPPD, NPPD, etc.) races will shape up with Tuesday's vote, which is why the primaries are critical for you to exercise your right to vote.

Bold is not publishing a primary election voter guide. We will publish a voter guide for the general election and post that sometime in early Fall. We do want to get some thoughts out there on the primaries and some of the key races. Feel free to comment, send us edits, add your own feedback on other races...but please go vote!

Equality in the Workplace: Lincoln Vote

On Monday, at 3pm, the Lincoln City Council will vote on workplace equality. Omaha voted recently to protect the rights of LGBT Nebraskans in the workplace and Lincoln could do the same today.

I grew up in a working class home in Omaha with a carpenter for a dad and a mom that worked overnights. She served as a volunteer union steward, coming home and sharing stories about what happened when people were not treated fairly in the workplace. This common-sense value, with a high degree of public support, doesn’t currently exist in our state's capitol the way that it should.

As I now travel back and forth between Omaha, where I was born, and Lincoln, where I’ve called home for a decade, I have been excited to see the growth in both of these communities. The unique, one of a kind shops and the large, national corporations that are calling Lincoln home provide a foundation for the culture and climate that many Lincolnites find so attractive.

We need to make sure that Lincoln does not fall behind. Other communities, including Omaha, have taken steps to treat all employees fairly. With the support of small business and community leaders, Outlinc called upon the Lincoln city council to take urgent action.

People should be judged at work by their performance, not their sexual orientation. If you work hard and do your job effectively, you shouldn’t be fired just because you’re gay, lesbian, bisexual or transgender. Great performance deserves a fair workplace. Gay and transgender people are productive parts of the Lincoln community, who contribute to the economy and it’s only fair they be able to earn a living like all other productive workers.

The Fairness Ordinance would continue Lincoln’s long-standing tradition of treating everyone fairly. In 1966, Lincoln became the first city in Nebraska to stand-up against workplace discrimination. We can continue to grow our attractiveness to businesses by promoting a value Lincoln was built upon: fairness.

Councilman Carl Eskridge deserves credit for his leadership when he introduced the Fairness Ordinance that will keep Lincoln competitive and treat people fairly. The final vote is now right at our doorstep, today, May 14.

ACTION

1) Contact your city council member, tell them as they get ready to vote on Monday (May 14th) that you support a "yes" vote to make Lincoln fair.

3) Join folks at an event in Lincoln at 6pm to share a dirnk and (hopefully celebrate the yes vote!)

DEQ Meetings on Pipeline Route

Starting this week, the Nebraska Department of Environmental Quality (DEQ) will host a series of meetings along the pipeline route where citizens and landowners can see the detailed maps of this new proposed route as well as ask questions to DEQ staff.
